Divorce is never easy, and when a shared home is involved, emotions can run even higher. If you’re facing the difficult question of how and when to sell your home during a divorce, you’re not alone. We've seen couples handle this a few different ways:

  • Sometimes one spouse keeps the home by buying out the other’s share if they can afford it, usually through a refinance.
  • More often, the home is sold and the proceeds are split before the divorce is final.
  • In other cases, the divorce is finalized first, and the decree spells out what happens with the home and equity.

If you decide to sell before a divorce decree is in place, both spouses need to be on the same page about timing, pricing, and offers. Both parties will need to sign the listing agreement and any purchase agreement. In many cases, it’s cleaner to wait until the divorce is final before buying. If you purchase before then, the home may still be considered marital property, which most people want to avoid. Waiting gives you a clear financial picture and ensures the home is titled only in your name.
